Court rejects Swamy’s plea against Chidambaram

NEW DELHI: Janata Party President Subramanian Swamy got a big jolt today when his plea against Home Minister P Chidambaram was rejected by a Delhi court.A Delhi court dismissed a petition by Swamy seeking to make Chidambaram an accused in the 2G case.

Rejecting his petition, the CBI Special Judge O.P. Saini said that Chidambaram did not indulge in any criminal conspiracy or derived any pecuniary advantage in the decisions taken with former Telecom Minister A Raja.

The judge said the plea of Subramanian Swamy is without any merit and therefore it is dismissed.

In his 64-page judgement, the judge said Chidambaram was party to only two decisions – keeping spectrum prices at 2001 level and dilution of equity by two companies.

The court said these are “not per se criminal”. The Special Court said there is no evidence on record that Chidambaram was acting in pursuit of the criminal conspiracy. The judge said he did not find any sufficient ground for proceeding against P Chidambaram.

Dismissing Swamy’s plea ,the Judge said a bit of evidence here and a bit there does not constitute prima facie evidence for showing prima facie existence of a criminal conspiracy.

He said anybody and everybody associated with a decision in any degree cannot be roped as an accused. There is no material on record to show that P Chidambaram was acting malafide in fixing the price of spectrum at the 2001 level or in permitting dilution of equity by the two companies.

The judge said the plea of Subramanian Swamy is without any merit and therefore it is dismissed.

Two days ago, the Supreme Court refused to direct CBI to investigate the alleged role of Chidambaram leaving it to the Special Court trying the 2G case.

Speaking to reporters Subramaniam Swamy said he will appeal against the trial court decision.

रालेगण सिद्धी, 14 जनवरी (वेबवार्ता)। गांधीवादी कार्यकर्ता अन्ना हजारे ने स्वामी रामदेव के चेहरे पर स्याही फेंकने की कोशिश को लोकतंत्र को कलंकित करने का प्रयास बताते हुए कहा कि ऐसे हमले जनआंदोलनों को नहीं रोक सकते। दमा की परेशानी होने के बाद अपने गांव में स्वास्थ्य लाभ कर रहे हजारे ने कहा, यह स्वामी रामदेव के चेहरे को काला करने का प्रयास नहीं था। यह लोकतंत्र को कलंकित करने की कोशिश थी। उन्होंने कहा कि किसी के बेदाग जीवन को वैसी स्याही से कलंकित नहीं किया जा सकता, जिसे दो मिनट में साफ किया जा सकता हो। लेकिन जिनका जीवन भ्रष्टाचार, गुंडागर्दी और लूट से कलंकित है, इन दागों को साफ नहीं किया जा सकता।

हजारे ने कहा कि रामदेव हमेशा समाज और देश की भलाई के लिए लड़ते रहेंगे और हमारे जैसे लाखों कार्यकर्ता उनका समर्थन करेंगे। स्वामी रामदेव ने अन्ना हजारे द्वारा मजबूत जनलोकपाल के लिए चलाए जा रहे आंदोलन को आरंभ में समर्थन दिया था लेकिन बाद में दोनों अलग हो गए। हजारे ने कहा कि ऐसे हमलों से जनआंदोलन बंद नहीं होंगे बल्कि और गहन होंगे। स्वामी रामदेव नयी दिल्ली स्थित कांस्टीटयूशन क्लब में एक संवाददाता सम्मेलन को संबोधित कर रहे थे तभी एक व्यक्ति ने उनपर स्याही फेंकने की कोशिश की। व्यक्ति को पुलिस ने गिरफ्तार कर लिया है और उस पर उन्माद फैलाने की कोशिश करने का आरोप लगाया है।
